JUDGMENT OF COURT In a ruling on a motion on notice for an order for special leave to appeal, their lordships held that, “The jurisdiction of this court under Rule 28 of the Supreme Court Rules to entertain an application for special leave to appeal is exercisable, as stated in Rule 9, where an appeal lies under any law with special leave either of the High Courts or of this court. Under section 8 of the Courts Act, 1960, which applies to this application, special leave is required only of the High Court and not either of the High Court or of this court. In the circumstances this court is incompetent to grant special leave to appeal. The application is accordingly dismissed with costs.”
