AKPAWEY vs. THE STATE

JUDGMENT OF OLLENNU J.S.C. Ollennu J.S.C. delivered the judgment of the court. The appellant was convicted of the offence of murder by the High Court, Accra, on the verdict of a jury. He appealed to this court on four main grounds; these are: “(1) that the learned trial judge failed to direct himself and the jury adequately and fairly on the defence of insane delusion. (2) That the learned trial judge misdirected the jury on the question of corroboration. (3) That the learned trial judge failed to put the case for the defence adequately and fairly before the jury. (4) That the judgment cannot be supported having regard to the evidence.” Learned counsel for the appellant argued ground (2) by itself and took grounds (1), (3) and (4) together. There were only two eye-witnesses to the commission of the act, the subject-matter of the charge; these are two little girls, each of tender years, who gave unsworn statements at the trial.
