AGYIRI ALIAS OTABIL vs. THE REPUBLIC

JUDGMENT OF WUAKU J.A. Wuaku J.A. delivered the judgment of the court. The appellant was charged with the murder of one Kwesi Atwere, a school boy aged fifteen years, at Manso-Amenfi on 6 January 1979. The appellant was tried before Twumasi J. and a jury and was convicted and sentenced to death. The appellant at the time he committed the offence was aged eighteen years. He now appeals to this court against his said conviction and sentence. The appellant until 6 January was living at Manso-Amenfi as a farm-hand to one Madam Akua Amenaa who is herself a farmer and an akpeteshie retailer. On 6 January 1979 the deceased was sent by his mother, the first prosecution witness, to go and deliver ¢320 worth of akpeteshie to Madam Akua Amenaa. The deceased duly delivered the akpeteshie to Madam Akua Amenaa. Akua Amenaa paid for the akpeteshie and wrapped the ¢320 in a rag and tied it around the waist of the deceased and sent the deceased together with the money back to his mother, t.....
