The applicants, directors of Accra Hearts of Oak Sporting Club, initiated suit No. 2917/87 challenging the validity of resolutions by the club's council of patrons which established a management committee with wide powers. While the suit was pending, the respondent, managing director of a local sports newspaper, published articles containing vituperative language and innuendoes perceived as prejudicial and contemptuous towards the applicants, describing them as 'saboteurs' and 'agents of destruction' in relation to the management committee and the ongoing litigation.
read moreOn 22 October 1987, the chairman of the board of directors and a director respectively of Accra Hearts of Oak Sporting Club caused a writ of summons to be issued on their behalf and on behalf of all other directors of the club against Nana Wereko Ampem II alias E. N. Omaboe and Nana Akoto Djan alias Harry Sawyerr who are also very important personalities in the club. While this suit No 2917/87 is pending, a number of articles have been published in a local sports newspaper known as Africa Sports. Of particular importance is the issue No. 101 and dated 2-9 May. The present applicants being highly aggrieved by those publications, have brought this application praying for an order of attachment of the respondent who is managing director of the said newspaper. What then is the nature of the applicants’ case?
