JUDGMENT OF OMARI-SASU J. On 26 November 1990 this court appointed the deputy chief registrar as receiver and manager to manage house No. F.197/1 Lokko Road, Osu, Accra pursuant to an ex parte application filed on 20 August 1990 by the applicant-respondent (hereinafter referred to as the respondent), Madam Grace Akle Mensah, daughter of Madam Rebecca Onnidin Barnor (Decd.) who built and owned the said house prior to her death. The affidavit in support of the said application averred, inter alia, that the respondent was the sole beneficiary of the will of the said Rebecca Onnidin Barnor (Decd.) and that after the will of the deceased was read to the family and prior to the filing of an application for grant of probate the respondent-applicant (hereinafter referred to as the applicant) filed a caveat at the registry of the court and since then he had been interfering with the property by collecting rents from the tenants in the premises in question.
