In January 1984, the plaintiff, a Ghanaian citizen by birth, was among persons accused of espionage for the US government and was allowed to leave Ghana under a government agreement. His Ghanaian passport was seized by security agencies prior to departure and was not returned. The plaintiff now resides in the US and seeks to return to Ghana, requesting restoration of his passport to apply for a new one. The Minister for Foreign Affairs, also the Attorney-General, received but did not respond to the request.

In or about January 1984, certain persons, among them the plaintiff, who were said to be engaged in espionage activities on behalf of the Government of the United States were permitted to leave Ghana under an agreement between the Governments of Ghana and the United States. In return, the Government of the United States permitted one Soussoudis, who had been convicted in the United States of engaging in espionage activities on behalf of the Government of Ghana, to leave the United States. While he lived in Ghana, the plaintiff, who claims to be a citizen of Ghana by birth, held a Ghana passport. The passport was taken from him by the security agencies some time before he left the country. The plaintiff now lives in the United States of America. He says he wants to return home.
