DATE OF COMPLAINT: 2nd November, 1998. CLAIM: Petitioner seeks assistance of the Commission to abate the noise made by the proprietor of Sranak Spot, Tesano. SUMMARY OF COMPLAINT: Petitioner alleges that owner of Sranak Spot plays music loudly from speakers and also organises dances and other functions. Inspite of appeals from petitioner and family the owner has not stopped. The noise has become intolerable because only a wall separates them. FINDINGS / OBSERVATIONS: The Commission arranged a Mediation and the respondent agreed to reduce the noise level. Petitioner reported after 4 weeks that he was satisfied that the respondent had abided by his word. DECISION / LAW: The Commission exercises its discretion under Section 13 (1) (b) of Act 456 that having regard to all the circumstances of the case any further investigation is unnecessary.
