INTRODUCTION The complainant was redeployed on 1st March 1993 at the age of 48. He was aggrieved because he was told by the respondent that he had opted for the Social Security Scheme while he on the other hand thought that he was a pensionable civil servant entitled to pension under the Pension Ordinance, 1951 (Cap. 30). The question is whether he is entitled to pension under the Social Security Scheme or the Pension Ordinance of 1951. COMPLAINANT'S CASE Following his redeployment in 1993, the complainant, though 48 years, applied for his pension since unlike the SSNIT Pension, one could claim under Cap. 30 at the age of 45 onwards. He was convinced that as a pensionable officer he was entitled to pension under Cap.30 RESPONDENT'S CASE The respondent denied that the complainant was entitled to claim under Cap.30.
