DATE OF COMPLAINT: 19/3/97. SUMMARY OF COMPLAINT: The Complainant stated that judgment was awarded in his favour at the High Court. Subsequently the defendant filed an appeal which is still pending before the Courts. CLAIM: Listing of Case for hearing at Appeal Court. FINDINGS / OBSERVATIONS: Investigations and an official Search revealed that the matter has not yet been listed but would be listed in due course. DECISION / LAW: The Commission ceases further investigation in this matter in accordance with Section 13 (1) (b) of Act 456 which states that "Where in the course of the investigation of any complaint it appears to the Commission - (b) that having regard to all the circumstances of the case, any further investigation is unnecessary, it may refuse to investigate the matter further.
