INTRODUCTION In his petition titled "PETITION AGAINST UNFAIR HANDLING OF A MURDER CASE", dated 10th September 1998, the Complainant stated that the Respondents had perverted the course of justice. He therefore requested the Commission to intervene in the matter to enable justice prevail. The 2nd Respondent investigated the alleged murder of Ben Avegbedor and submitted the case docket to the Attorney-General's Office in Ho, Volta Region, that advised that the 5 occupants of the LT Bus registration No. GR 9589 G be charged with smuggling. COMPLAINANT'S CASE According to the Complainant, CEPS officials shot dead his brother, Ben Avorgbedor, at Mepe in the Tongu District of the Volta Region of Ghana, whilst his other two siblings, Richard Avorgbedor and Elikplim Avorgbedor, sustained gun shot wounds without the least provocation from them.
