SEIDU CHAMAGOU AND NAADU LAMPTEY
On 13th October 1998, Seidu Chamagou lodged a complaint with this Commission. The complainant alleged that he has been taking care of 2 children of his late son in the past 22 years following the death of his son. The children's mother never looked for them. She has now instituted an action against him in court for child abduction. He has thus been ordered by the court to produce the two children in court. The complainant's fear is that the children will not be returned to him if brought to court. The complainant wants a guarantee from the Commission that the children will be returned to him when produced in court. Since the subject matter of this complaint was pending before court the Commission's jurisdiction was thus ousted by virtue of Section 8(2)(a) of Act 456. Due to the above, the Commission took a neutral position and appeared in court as a friend of court to watch over the brief.
