INTRODUCTION In a complaint dated 9th February 2000, the Complainant asked this Commission to use its good offices to resolve his pension problem for him. THE COMPLAINANT'S CASE The Complainant stated that he qualified as a teacher in 1971. He taught for 9 years before leaving for Nigeria. He stated further that he was re-employed into the Ghana Education Service (GES) in 1993. In 1997, he had to take voluntary retirement on the grounds of ill health. He stated also that on processing his paper for pension and gratuity, he was informed by the GES that he had broken service and had therefore forfeited his pension and gratuity. He said that he was not informed of this provision when he joined the service in 1971. THE RESPONDENT'S CASE The Respondent stated that the Teachers’ Pension Ordinance, Cap 23 of 1955 precludes a person from enjoying pension if he vacates his post for more than a year.
