UNDISPUTED FACTS Ghana Reinsurance Company Ltd (Ghana Re), the 1st Respondent, was a public corporation operating under the name Ghana Reinsurance Organisation until July 1995 when it was incorporated as a private limited liability company with the Government as the sole shareholder. Patrick Kpodo (the Complainant) was the Executive Chairman of Ghana Re, until 4th September 1995, when upon the directive of the President, he was interdicted by the Minister of Finance (the Minister), the 2nd Respondent. The letter of interdiction, dated 4th September 1995, cited the report of preliminary investigations conducted by the National Insurance Company (NIC) into the management and investments of funds by the Ghana Re as the basis for the President's directive, On 4th December 1995, the Commissioner of Insurance (the 3rd Respondent) set up a three-member Special Committee, with himself as Chairman, to investigate the affairs of Ghana Re.
