INTRODUCTION In a complaint dated 20th March 2001, the Complainant asked this Commission to investigate the circumstances leading to the termination of her appointment with the Respondent. The issue to be determined by this Commission is whether or not the Complainant was wrongfully terminated. THE COMPLAINANT CASE The Complainant stated that she was a teacher in the Respondent's nursery school. She stated further that she fell pregnant, applied for and was granted maternity leave on 23rd June 2000. She stated however, that a letter dated 26th July 2000 was handed to her terminating her appointment. The reason for termination was given as follows: "The Board of Management has decided to terminate your appointment as of 1st of September 2000 as it does not want to employ nursing mothers anymore."
