1996 GHANA PUBLISHING CORP. REDUNDANT STAFF AND GHANA PUBLISHING CORPORATION

The complainants, redundant staff of Ghana Publishing Corporation following a restructuring exercise on 1 March 1996, alleged underpayment of terminal benefits. They claimed management calculated severance pay based on basic salary rather than consolidated salary, contrary to government directives and Section 50 of their 1993 Collective Agreement. They also contended that management failed to provide the required notice or payment in lieu of notice (3 months for senior staff, 1 month for junior staff), did not pay funeral grants for employees with 15 or more years of service, and withheld salary increments affecting severance pay and SSNIT pension.

Introduction In a letter dated 18th April 1997, the Office of the President referred Complaint made by the Complainants to it to this Commission for investigations. The Complainants' Case The Complainants stated that the Respondent had short-paid their terminal benefits after a restructuring exercise on 1st March 1996. They stated further that although they had petitioned the Ministry of Labour and Social Welfare, their complaint had fallen on deaf ears. They asserted that management had failed to use their consolidate salary in the computation of their terminal benefits but calculated it based on their basic pay. This, they contended, was in violation of Government directives and also in contravention of Section 50 of their 1993 Collective Agreement.
