The Complainant filed his petition in 1994 at our Tamale Office against the Respondent Company claiming damages for wrongful dismissal and compensation for injuries sustained while on duty. In a decision rendered on 15th December, 1995, the Commission granted the petitioner the following reliefs: 1. payment of all entitlements including end-of-service benefits. 2. damages for unlawful dismissal. The Respondents had contended that the petitioner had been summarily dismissed for being drunk during working hours and justified their action by clause 8(3)(9) of the then operative Bargaining Agreement. The Commission took the view that the offence for which the petitioner was dismissed summarily was not provided for under the said section of the Collective Bargaining Agreement, hence the decision to grant the petitioner these reliefs.
