INTRODUCTION In the complaint received on 27th March 2003, the Complainant alleged that he was knocked down by a vehicle while riding his bicycle. The matter was reported to the Police who in their prosecution have failed to locate a witness in the case for its speedy trial. The Complainant therefore petitioned the Commission to assist in enhancing fair trial. FINDINGS Comments on the above matter received from the Respondent indicated that the matter is pending before Greater Accra Circuit Tribunal Court 'B' complainant should petition the Judicial Service for any further action. DECISION In the light of the above findings, the Commission ceases further investigation into the matter in accordance with Section 8. (2) (a) of Act 456 which states: Section 8. (2) "The Commissioner shall not investigate (a) A matter which is pending before a court or judicial tribunal."
