INTRODUCTION After hearing both parties on this complaint, the Commission holds the view that the. Respondent exercised their legitimate right in dismissing the Complainant and that the dismissal was not wrongful. The complaint was dated 18th September 2001. The Commission received it the following day. THE SUBSTANCE OF THE CASE The Complainant stated that he was appointed a staff of the Respondent between March and April 1995. He worked as such till 2nd November 2001 when he was dismissed. He claimed that on 2nd November 2001, he was assigned to off-load some goods belonging to the Respondent into a warehouse. In the process, the Respondent's storekeeper instructed him to search the Respondent's cold room for four cartons of fish belonging to a customer. The customer reportedly could not find the cartons of fish. The Complainant further stated that he found and put two of the cartons on a truck but in addition, he found some waybills on the truck.
