INTRODUCTION James Bruce Smith was a remand prisoner at James Fort for the past 5 months. The Complainant brought a petition to the Commission for his release as a result of non-tial. However, the Respondent stated that the delay in trying the remanded prisoner was due to the transfer of the investigator of the case to a new schedule. COMPLAINANT'S VERSION According to the Complainant, James Bruce-Smith was remanded in the prisons custody for 5 months without being tried by the court of law. The Complainant alleged that Mr. Bruce-Smith was charged with rape. He appealed to the Commission to ensure that justice was done to Smith for a speedy trial. RESPONDENT'S VERSION The Commission contacted the James Fort Prison and was directed to contact Nungua Police for further information. On 21st April 1999, Mr. Adu Poku of Legal Advice Office of the Police Administration, was interviewed on the case under reference.
