JUDGEMENT Asare Korang JA. On 25 May 2005 the High Court, Kumasi presided over by Ansu-Gyeabour J dismissed the preliminary objections raised by the respondent-appellant (hereinafter referred to as the respondent) and the interested party-appellant (hereinafter referred to as the interested party) against an application for an order of mandamus filed by the appellant-respondent (hereinafter referred to as the applicant). Aggrieved by the ruling of the trial High Court, the respondent and the interested party have appealed to this court. What are the facts giving rise to the application for mandamus? They are as follows: The applicant was on 24 June 1994 enstooled as the Omanhene of Wassa Fiase Traditional Area.
