FARKYE, JA This ruling is in respect of motion on Notice for extension of time limited for appeal. From the affidavit in support of the motion for extension of time within which to appeal the judgment of the suit which was commenced in 1996 was delivered on the 7th May 2004. Exhibit TT8 refers. In the supplementary affidavit in support of the motion for leave for extension of time within which to appeal paragraph 3 stated that on the 5th of July 2005 the Defendant/Applicants had its motion for extension of time within which to appeal dismissed by the High Court in Accra. The Defendants/Applicants have repeated the application at the Court of Appeal. The motion for extension of time was refused because the application was completely out of time. The judgment was given on the 17th May 2004 and the application for extension of time within which to appeal made on the 17th July 2005.
