MARFUL - SAU. J.A This appeal is taken from the judgment of the High Court Accra dated the 24th February 2004. By a writ of summons, the Plaintiff/Appellant hereinafter called the Plaintiff claimed the following:— (1) Recovery of the sum of ¢233,200,000.00 being outstanding balance of financial assistance granted to the Defendant and (2) Interest on the said sum from April 2002 till the date of final payment at the prevailing interest rate. The Defendant/Respondent hereinafter called Defendant by her statement of defence also counterclaimed as follows:— (1) An order compelling the Plaintiff to refund to Defendant the sum of ¢291,000,000.00, which the Defendant overpaid to her. (2) Interest on the said amount from 10th July 2001 to date of full and final payment. (3) General damages for breach of contract to lend Defendant ¢475,000,000 to make a total of ¢1 billion.
