THE REPUBLIC vs. EDDIE ACQUAYE & 2 ORS EX-PARTE: NANA KOJO EWUSI AND 2 OTHERS

TWENEBOA-KODUA, J.A. This is an appeal from the ruling of the High Court, Cape Coast. The court below dismissed an application seeking an order for the attachment of the respondents herein, who were also respondents in the court below, for contempt. Aggrieved by and dissatisfied with the said ruling, the appellants, who went to the court below as applicants, have launched this appeal on grounds as set out below. The appellants' original ground of appeal states:— "The entire ruling is manifestly against the weight of the evidence adduced at the trial." The first additional ground of appeal reads:— "The learned trial judge erred in law in holding that an action in chieftaincy as was determined by the Judicial Committee of the Central Region House of Chiefs in the suit entitled Ebusuapanyin Kojo Abor and others versus Nana Abor Ewusie XIX is a personal action that abated upon the death of the appellant, Nana Abor Ewusie XIX".
