A background to this appeal is as follows: On 27th of March, 2002 the plaintiff/respondent in this appeal filed a writ of summons at Cape Coast Circuit Court against the defendants jointly and severally for: (a) Declaration of title to all that piece or parcel of land situate lying and being at a place commonly known and called ‘Abosantsen’ in the vicinity of Abura Edukrom which piece or parcel is bounded on two sides by the property of Ebiradze Family Amosima, on one side by the Oman of Amosima (represented by Supi Forson) and on the remaining side by a portion of plaintiff’s ancestral land. (b) Recovery of Possession. (c) Damages for Trespass (d) Perpetual Injunction restraining defendants, their agents, servants etc. from interfering with the plaintiff’s family’s title and interest.
