RULING ATUGUBA JSC This is an application for special leave under section 4(2) of the Courts Act, 1993 (Act 459), and article 131(2) of the 1992 Constitution to appeal to this court against the decision of the Judicial Committee of the National House of Chiefs dated 27 February 1995 involving the parties herein. The pertinent background to this application is that the petitioners­ appellants-applicants (hereinafter called the applicants), lost a petition in the Volta Regional House of Chiefs against the nomination, election and enstoolment of the fourth respondent as the Paramount Chief of the Akpini State. Having again lost in the National House of Chiefs, on appeal, they obtained leave to appeal on 14 April 1999 and did file an appeal to this court on 28 April 1999. When the applicants were served on 26 October 1999 with a notice of dispatch of the record of proceedings dated 18 October 1999, they sent it to Mr Ahenkorah, their counsel.
