JUDGMENT This is an appeal from the decision of the District Magistrate sitting at the Ministries District Court, Accra on the 1st day of August, 2008. In a Notice of Appeal filed with the leave of the court below on the 10th day of December, 2008 the Plaintiff/Appellant has attacked the judgment of the District Court on 2 main grounds, namely: 1) That the judgment is against the weight of the evidence adduced at the trial. 2) That the trial Magistrate misdirected himself when he held that Defendant was a lawful landlord. Accompanying the Notice of Appeal is Counsel’s Written Submissions filed on the 28th May, 2009 setting out his legal arguments urging on this court to allow the appeal. Before going further I think it is appropriate to chronicle in brief, the facts of this case. It is common ground that the defendant/respondent whom I will subsequently refer to only as defendant took occupation of a chamber and a hall residence in H/No. E 142/12, Nima, Accra. .....
