GHANA NATIONAL ASSOCIATION OF TEACHERS (GNAT) vs. STANDARD CHARTERED BANK OF GHANA

The plaintiff is a voluntary association of teachers and a customer of the defendant bank and has sued for the following reliefs: a) Refund of the sum of GH¢47,412.40 being the total value of cheques negligently and wrongfully paid by the Defendant from the Plaintiff’s account No. 0100100589800 with the Defendant’s High Street Branch without the Plaintiff’s mandate. b) Interest on the said sum at the current bank rate from 31st May 2006 to date of final payment. c) Costs. The plaintiffs case is that between 15th February 2006 and 18th May 2006, the defendant wrongfully paid from one of its accounts 30 cheques with a total value of G¢47,412.40 without its authority. [At the trial, 28 cheques were tendered with the same face value]. The plaintiff asserts that the signatures on the cheques were not those of the authorised signatories of the account i.e. the General Secretary Irene Duncan-Adenusa and the National treasurer Leticia Hammond.
