KEVIN DINSDALE GORMAN, MOHAMMED IBRAHIM KAMIL AND SVEN LEONARD HERB (APPELLANTS) vs. THE REPUBLIC
The appellants, along with others, were charged and convicted for conspiracy, importation, possession, and use of property for narcotic offences involving 588.33 kilograms of cocaine found in a false compartment in the 1st appellant's house in Tema. The drugs were landed at Prampram beach and transported by the appellants. The 1st appellant owned the property where the drugs were concealed. The prosecution alleged conspiracy and possession of narcotic drugs without lawful authority.
read moreVICTOR D. OFOE, JA: Whilst the case stood adjourned for judgment, the 2nd appellant filed a motion praying the court for leave to adduce fresh evidence. I am in agreement with my able senior sisters’ opinion that the application should be refused. There were six accused persons at the trial court. They are Kevin Dinsdale Gorman, Mohammed Ibrahim Kamil, John David Logan , Frank David Laverick, Allan William Hodgson and Sven Leonard Herb. They were all convicted of all the offences for which they were charged before the trial court. The appellants before this court Kevin Dinsdale Gorman, Mohammed Ibrahim Kamil and Sven Leonard Herb were the 1st, 2nd and 6th accused persons before the trial court. The offences for which they were convicted I reproduce as follows: COUNT ONE STATEMENT OF OFFENCE Engaging in conspiracy to commit an offence relating to narcotic drug contrary to Section 56(c) of the Narcotic Drugs (Control Enforcement and Sanctions) Law, P.
