INTRODUCTION The Complainant (Arthur Richard) prayed the Commission to secure refund of underpayment of his per-diem allowance from the Respondent (Ministry of Energy) in respect of a course he undertook in Liquefied Petroleum Gas (L.P.G) in the Republic of South Korea in August 1997. The Respondent on the other hand failed to provide the necessary comments to the Commission in spite of several letters for comments coupled with invitation for discussion and the Complainant's consistency. The Commission has no other option than to decide the case based on evidence available and on a similar ruling by the Commission in favour of Emmanuel Obimpeh vs. Ministry of Mines & Energy. ISSUE The issue for determination in this matter is: Whether the Complainant is entitled to any refund.
