FACTS The Complainant a former Finance Manager of respondent alleged that after his retirement in August 2006, respondent failed and/or refused to pay some of his medical bills. He further alleged that even though a colleague of the same rank who later on retired in September 2006 was paid an Ex-gratia award and all his medical bills, complainant was not paid any Ex-gratia. The complainant contended that this action of respondent amounted to discrimination. OBSERVATION At a discussion held with both parties the Commission made the following observations: 1. That the respondents changed their internal policy regarding Ex-gratia payments commencing from September 2006. 2. That at the time complainant retired the respondent did not pay Ex gratia to its retiring employees. 3. The Terms of the Conditions of Service of the respondent before September 2006 did not provide for the payment of Ex-gratia to retiring employees. 4.
