THE REPUBLIC vs MICHAEL TAGOE (ALIAS NII ARMAH) & 3 ORS
JUDGMENT The accused person and three others were charged with two counts of offences. First, conspiracy to commit crime namely robbery contrary to Section 23(1) and 149 of the Criminal Code 1960 Act 29 as amended. Second, robbery contrary to Section 149 of the Criminal Code 1960 as amended. The prosecution called two witnesses at the trial. The 1st prosecution witness (PW1) is Samuel Mark Darko and the second prosecution witness PW2 is Cosmos Ahiakpa the Police Investigator. When the Investigator sought to tender in evidence the statement allegedly taken from the 3rd and 4th accused persons objections were taken to their reception in evidence. This necessitated a mini trial after which the said statements were rejected. The prosecution announced the closure of its case thereafter. After a submission of no case has been made on behalf of the accused persons, the Court found that there was no evidence against the 3rd and 4th accused persons who were, as a result, discharged ...
