FRANK APPAH vs. GHANA RAILWAY CORPORATION

The applicant issued out Writ of Summons against the defendant on 17th November, 2000 for the following reliefs: “1. The recovery of the sum of ¢12,800,000.00 being the cost of assorted beams and scantlings entrusted to the defendant (to convey from Atieku to Dome near Accra) who loaded them on van No. 5063 on 9th September, 1998 but which it has failed to deliver despite several demands. 2. Interest on the sum of money from the 9th day of September, 1998 at current bank rate till the day of payment. 3. Costs.” The plaintiff accompanied the Writ of Summons with a Statement of Claim in which he avers that on 9th September, 1998 the defendant hired its van No.5068 to him to load assorted beams and scantlings from Atieku to Dome in Accra.
