MARFUL-SAU JA; This appeal is taken from the judgment of the High Court; (Fast Track Division) dated the 22-12-08. In this appeal the plaintiff will be referred to as the Appellant and the Defendants would be referred to as the Respondents. By the Notice of Appeal filed on the 28-4-09, the Appellant appealed against the judgment dated the 22-12-08 and the ruling delivered by the trial court dismissing Appellant’s application for review. Before I proceed further, I need to comment on the procedure adopted by Counsel for Appellant in initiating this appeal. The trial court delivered a final judgment in Suit No. AHR52/2007 on the 22/12/2008. Under the Court of Appeal Rules, CI 19 as amended appeals against final judgments are regulated by specific rules. For example by Rule 9(1) (b) the time limit for appealing against a final decision, like the judgment of 22-12-08, is three months unless extended by the court.
