JUDGMENT By a writ of summons dated the 17th day of December, 2006 the Plaintiff claims against the defendant: “(a) An order against the defendant for an amount of US D 673,766.66 or its cedis equivalent and interest thereon up to the final date of payment. (b) Costs” The writ was accompanied by a statement of claim which was subsequently amended. After entering appearance to the writ, the defendant filed a defence and later amended it to include a counterclaim for “(a) Unpaid remuneration of USD 805,000 representing 20% of the volume of trade within the period. (b) Damages for breach of contract (c) Cost on full indemnity basis”. After the close of pleadings the following issues were set down by the court for trial: 1) Whether or not the defendant has been importing goods on credit from the plaintiff and paying for same overtime. 2) Whether or not accounts of the two parties have been audited. 3) Whether or not the defendant is indebted to...
