KINAPHARMA LIMITED vs. THE ATTORNEY- GENERAL, THE MINISTRY OF ROAD AND HIGHWAYS AND LEDZORKUKU KROWOR MUNICIPAL ASSEMBLY

On 27-05-2010, the applicant, Kinapharma Limited, invoked the jurisdiction of this court for the following reliefs: a) A declaration that it is unconstitutional and a breach of the fundamental human rights guaranteed by the 1992 Constitution for the respondents, that is, The Attorney-General, the Ministry of Road and Highways and the Ledzorkuku Krowor Municipal Assembly, and for any other institution which forms part of the organs of the respondents to go ahead and demolish applicant’s property situated around the Spintex road. b) An order of perpetual injunction restraining the respondents from demolishing the applicant’s property. On the same 27-05-2010, the applicant filed an application on notice for interlocutory injunction for an order to restrain the respondents, their agents, servants, workmen and privies from entering or demolishing the property in dispute in any manner whatsoever pending the hearing and final determination of the substantive suit.
