GATEWAY SERVICES LTD. vs. NATIONAL LABOUR COMMISSION

This ruling is in respect of motion on notice filed by the Respondent/Applicant for an order to strike out the Notice of Appeal filed by the Appellant/Respondent on 15th October, 2008 for non-compliance of the conditions of appeal under Order 51 Rule 6 of CI 47. According to the Respondent/Applicant, one Joseph Okai filed a petition against the Appellant/Respondent. The Respondent/Applicant sat on the case and ruled against the Appellant/Respondent on 3rd October, 2008. The Appellant/Respondent being dissatisfied filed Notice of Appeal dated 15th October, 2008 against the decision of the Respondent/Applicant at the High Court, Accra. The Respondent/Applicant goes on to aver that after settlement of records, the Appellant/Respondent was served with the conditions of appeal on 19th June, 2009.
