THE REPUBLIC vs. THE DISTRICT COURT, EJISU-ASH EX PART HAJIA HAWA (IBRAHIM GRANT INTERESTED PARTY)

The applicant has filed an application in this court praying for a writ of certiorari to remove the decision of Ejisu District Court of 3rd August, 2010 that ordered the doors to House Number Plot 11 Block 11, Kwamo, to be forced open to give access of it to one Ibrahim Grant the interested party herein into his court for the purpose of quashing it. By a motion ex parte, the interested had moved the Ejisu District court and granted the order under attack. The affidavit in support of the motion was rather brief. It was as follows: “I Ibrahim Grant of H/No. Plot 11 Block K, Kwamo in the Ashanti Region make oath and say as follows: 1. That I am the Deponent herein 2. That I am the undisputed owner of H/No plot 11, Block H, Kwamo 3. That the defendant has unlawfully locked up the room preventing me to have access 4.
