The plaintiff, a Ghanaian citizen and supporter of Tema Youth Football Club, challenged certain provisions of the Ghana Football Association (GFA) statutes, specifically article 17.1.11.16, which purported to oust members and supporters from resorting to the courts to ventilate grievances and coerced football clubs to avoid associating with such actions under threat of expulsion. The plaintiff sought declarations that these provisions were inconsistent with Chapter Five of the 1992 Constitution and thus void, and an order restraining the GFA from requesting disclaimers in court actions commenced by supporters.
