HONYENUGA, J.A This is an appeal by the 2nd Defendant/appellant from the decision of the High Court; Accra dated the 26th day of November, 2009. The said decision decreed ownership of the land together with buildings thereon to the plaintiff/respondent and further ordered the 1st defendant to execute an indenture in respect of the two plots of land in favour of the plaintiff/respondent. The decision also decreed recovery of possession, damages and perpetual injunction against the defendants/appellants. The facts of this appeal are that the plaintiff/respondent who is a policeman was the husband of the 2nd defendant/appellant. The plaintiff/respondent purchased two plots of land from the 1st defendant at a cost of ¢9,000,000.00 or GH¢900.00 in the presence of the 2nd defendant/appellant for which a receipt was issued.
