RULING Following conflicting claims over an area of land situate at Mamobi, the 1st, 2nd and 3rd Claimants appeared before the Land Title Adjudication Committee Tribunal under Sections 22 and 23 (6) (b) of the Land Title Registration Law, PNDCL 152. The statement of Claim of the 3rd Claimant Applicant herein before the Land Title Adjudicating Committee, attached to the instant application as exhibit “A-5” sought for: a) Declaration of title to all that piece or parcel of land situate lying and being at Maamobi and bounded on the North-East by lane measuring 70 feet more or less. b) Perpetual injunction restraining the 1st and 2nd Claimants by themselves, their agents, assigns and privies or otherwise howsoever from entering the land in dispute. On 13th December, 1994 the Land title Adjudicating Tribunal gave judgment against the 3rd Claimant/Applicant herein. Dissatisfied the 3rd Claimant/Applicant successfully appealed to the High Court.
