This case was heard to finality by the late Justice Nana Gyamera Tawiah and my only duty is to order Addresses and Write the Judgment as I do. By an amended Writ of Summons filed on the 24th day of January 2006, the plaintiff claims against the defendant as follows:- “(a) A declaration that the plaintiff has no obligation to the defendant in respect of One Hundred and Fifty Thousand United States Dollars (US$150,000.00) owed to the defendant by Allied Trade and Finance Company. (b) An order that the Deed of Assignment dated the 25th day of February 2001, be delivered up to the plaintiff and cancelled. (c) Alternatively if the court is of the opinion that the Deed of Assignment is still binding on the plaintiff, a declaration that the Deed of Assignment is in substance a mortgage.
