On 16th November, 2006, the Effiduase District Court presided over by His Lordship R. Asiedu Badu, as he then was, entered judgment for the plaintiff respondent, to be referred to in this judgment simply as the plaintiff, in action in which he claimed declaration of title to a piece of land, perpetual injunction and damages for trespass. By his amended writ of summons filed in the registry of that court on 4/5/05, the plaintiff claimed the following reliefs: “(1) A declaration that the piece or parcel of land at Asokore at a place commonly known and called “ANNU-AGYA” on Asokore stool land and bounded by the property of Opanin Abrokwa, Akwasi Gyamfi, God Nyame, Opanin Nyanor and Anunu River is the family property of the plaintiff. (2) Perpetual injunction restraining Defendant, her relatives, agents and / or workmen from interfering with the land.
