RULING Learned Counsel for applicant prays this Court to stay Execution of its judgment delivered on the 11th December, 2013. I do not wish to rewrite the judgment. Having listened to the arguments of applicant and the respondent, the judgment/creditor/respondent, with respect to the judgment delivered on the 11th December, 2013, it is my considered view that there is no likelihood of success of the applicant’s appeal. On the issue that, the respondent cannot pay back the amount, I have not been shown any insolvency of the respondents or bankruptcy. He is a Ghanaian with Lebanese lineage. He has properties here which could be attached and sold granted the applicant wins the appeal. Application is hereby refused. Cost of GH¢2,000.00 to the respondents.
