JUDGMENT Per his writ of summons sealed in this registry on 15/10/09, the Plaintiff claims against the defendants, the reliefs set out here below: 1. An order ejecting the defendants from the premises 2. Costs. The defendants entered conditional appearance to the claim but defaulted in taking any steps pursuant to filing the conditional appearance neither did they file a statement of defence within the time permitted by the rules. In the result, learned Counsel for the Plaintiff applied for judgment in default of defence. That then prompted the defendants to file on 25/01/10, a late Statement of Defence and counterclaim which were admitted by the court to form part of the pleadings. I need to put it on record that the Statement of Defence and counterclaim was subsequently amended. The Amended Statement of Defence did not contain a counterclaim, however.
