The Plaintiff was the wife of one Paul Fiagbor (deceased) who until his death was an employee of the Defendant Company. In the course of his duty as a driver of the Defendant Company he died in a motor accident on the Accra to Kumasi motor road on 12th April, 2006. On his death the Defendant paid out GH¢10,767.06 on 7th March, 2008 to dependants of the deceased, including the Plaintiff herein, workmen’s compensation. Nothing more was paid them until a year later, after Counsel for the Plaintiff had intervened by writing to the Defendant. Upon Counsel’s intervention, the Defendant paid additional amount of GH¢12,166.20 on 25th February, 2009 to the Plaintiff. However, using the deceased’s April, 2006 salary statement of GH¢398.32, Plaintiff computed the compensation due her per section 3(1)(a) of the Workmen’s Compensation Act, 1987, (PNDCL 187) and obtained GH¢23,899.20.
