NANA YAWS ODURO vs. MICHAEL ADUSEI & OTHERS

This is a ruling regarding an application for stay of execution of the judgment of this Court delivered on 24th May, 2012. The application was filed by the 2nd defendant/appellant/applicant, to be referred to simply as the 2nd defendant for an order to stay the judgment to enable it pursue an appeal against it at the Court of Appeal. The judgment under attack was entered in favour of the plaintiff/respondent, to be called the plaintiff, in respect of a parcel of land known as property No. 1 Block ‘A’ Adum Light Industrial Layout, Kumasi. The property was bought by the plaintiff through the co-defendant who acted as his counsel, but was resold to the 2nd defendant by the co-defendant, under circumstances, the plaintiff claimed he was unaware of, and did not give his consent to the sale.
