RICHARD KONADU vs. ANTRAK GH. LTD. AND OTHER

The plaintiff is the owner of Kia Trade truck with registration number AW 369 X. On 26 June, 2008, the truck got involved in an accident at Sawaba Junction with a Volvo Articulator truck owned by the first defendant company and driven by the second defendant. It was not disputed that the second defendant drove the Volvo truck in the normal course of his employment as driver, servant and/or agent of the first defendant. It is the case of the plaintiff that the Kia truck was then driven by one Isaac Opoku who testified as the second witness for the plaintiff. He shall be referred to hereafter as PW2. Plaintiff asserted that the accident occurred when the second defendant made a u-turn at Anloga junction in an attempt to drive back to Anloga from which direction he drove towards Sawaba junction.
