HALARU SULEMANA OF EJURA vs. ALHAJI NUHU OF EJURA

This is an appeal by the defendant/appellant, herein called the defendant, against the decision of Ejura District Court presided over by His Worship Amadu Issifu. In that judgment, delivered on 24th March, 2010, the trial court ordered the defendant to refund an amount of GH¢2,568.00 to the plaintiff/respondent, to be referred to in this judgment as the plaintiff. The award was made up as follows: GH¢ (a) The award itself 2,500.00 (b) Filing fees 18.00 (c) Costs 400.00 (d) General damages 400.00 Total 3,318.00 The total figure arrived at by the district court was GH¢ 3,068.00. Clearly, it was a wrong addition and that affected the amount ordered to be paid. The amount should have been GH¢2,818.00 instead of GH¢ 2,568.00 as appeared in the judgment of the district court if the GH¢500.00 allegedly paid is taken account of.
