Georgia Hotel Limited purchased a brand new Mercedes Benz E240 Avantgarde from Silver Star Auto Limited in October 2004. In September 2006, after minor repairs at the defendant's workshop, the vehicle broke down en route to Kumasi. A private mechanic declared the engine defective. The plaintiff claimed latent defects in the vehicle and sought replacement or payment for the vehicle, loss of use, and costs.

The plaintiff company had the vehicle towed to Kumasi and inspected by a private mechanic who declared the car engine defective. After that the plaintiff company brought a claim against the defendant company alleging that the vehicle suffered from latent defects.
