THE REGIONAL SECRETARIAT GPRTU OF TUC BOLGATANGA & ANOR vs. BUGRI MAHAMA BABA & 3 OTHERS

IRENE C DANQUAH, J.A This is an interlocutory appeal against the ruling of the Circuit Court, Bolgatanga dated 20th February 2012. In the said ruling, the Court dismissed the Defendants/Appellants (Defendants) preliminary objection to the jurisdiction of the Circuit Court to try the suit filed by the Plaintiffs/Respondents (Plaintiffs) who sought the following reliefs: 1. Declaration by the honourable Court that the failure by the Upper East Regional Secretariat of GPRTU to present an audited account of the Region for the 2007, 2008, 2009 and 2010 financial years is unconstitutional and therefore a flagrant violation of the mandatory provisions of Article 16 of the GPRTU Constitution. 2. An order of the Court prohibiting the 2nd Defendant and his colleague Regional Executive from contesting the forthcoming election for violating the mandatory provisions of the constitution particularly Article 16. 3.
